Terms and Conditions
1. Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as “Customer”) and the seller LAV – Owner: Lea Antonia Varga (hereinafter referred to as “Seller”) through the online store Sentio Manuscripts. Any differing terms of the Customer shall not apply unless expressly agreed upon.
1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the course of their commercial or self-employed professional activity.
2. Conclusion of Contract
2.1 The presentation of goods in the online shop does not constitute a legally binding offer by the Seller.
2.2 The Customer first places the selected products in the shopping cart. In the following steps, all necessary order data is collected. Only by clicking the final button to complete the purchase does the Customer submit a binding offer to purchase the items in the cart.
Alternatively, the Customer may submit their offer via email, post, or telephone.
2.3 The Seller may accept the Customer’s offer by:

Sending a written or electronic order confirmation (via email), or

Requesting payment after the order has been placed, or
-
Dispatching the ordered goods.
The earliest of these actions is deemed the time of contract conclusion. If no acceptance is declared within five days, the offer is considered rejected.
2.4 If the Customer selects "PayPal" or "PayPal Express" as the payment method, payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The PayPal User Agreement applies: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full
In this case, by clicking the final order button, the Customer also submits the payment instruction to PayPal. Upon this payment instruction, the contract is deemed concluded immediately.
2.5 The contract text is stored by the Seller. The GTC are accessible on this page. Order details, the cancellation policy, and the GTC are sent to the Customer by email. After the purchase, the contract text is no longer accessible online.
2.6 All input fields are displayed prior to final submission and may be reviewed and corrected using browser functions or specifically labeled correction buttons.
2.7 The contract language is German.
2.8 It is the Customer’s responsibility to provide a valid email address and ensure the receipt of order-related messages.
3. Prices and Payment Terms
3.1 Prices shown are total prices including statutory VAT unless stated otherwise. Additional shipping charges are listed in the product description.
3.2 Available payment methods are displayed in the online shop.
3.3 Payments via “PayPal” are processed through PayPal (Europe) under their terms: [see link above].
3.4 For payments via PayPal Checkout, the Seller may assign their claim to PayPal or its partners. If the chosen method requires a credit check, PayPal may reject the payment option in case of negative results. Payment is only valid once received by PayPal or the selected partner.
4. Delivery and Shipping Conditions
4.1 Delivery takes place to the address provided by the Customer. In the case of PayPal payments, the delivery address stored in the PayPal account is binding.
4.2 If the Customer provides an incorrect or incomplete address, resulting in delivery issues, the Customer bears the resulting costs—unless not at fault.
4.3 For local pickup, the Seller will notify the Customer once the product is ready. Pickup is by appointment only. No shipping costs apply in this case.
5. Right of Withdrawal
5.1 Consumers generally have a right of withdrawal.
5.2 The Seller's Withdrawal Policy applies.
5.3 Consumers outside the European Union at the time of contract conclusion are not entitled to the right of withdrawal.
6. Retention of Title
Until full payment is received, all goods remain the property of the Seller.
7. Liability for Defects
7.1 The statutory provisions on liability for defects apply unless otherwise agreed.

For used items, the warranty period is one year from delivery.

This limitation does not apply to goods used in construction, to claims for damages, or where the defect was fraudulently concealed.
7.2 Customers are encouraged (but not obligated) to report obvious shipping damages to the carrier and notify the Seller.
8. Liability
8.1 The Seller is fully liable for damages resulting from intentional or grossly negligent behavior, as well as for injury to life, body, or health.
8.2 For breaches of essential contractual obligations (cardinal duties), liability extends to typical foreseeable damages even in cases of slight negligence.
8.3 Further liability is excluded. The same applies to the Seller's agents or vicarious agents.
9. Applicable Law
9.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations of the Customer’s country of residence remain unaffected.
9.2 This choice of law does not apply to consumers from non-EU countries with non-EU delivery addresses at the time of contract conclusion.
10. Jurisdiction
10.1 If the Customer is a merchant or legal entity under public law based in Germany, the Seller’s business location shall be the exclusive place of jurisdiction.
10.2 For Customers outside Germany whose orders relate to business activities, the Seller’s business location is also the place of jurisdiction. However, the Seller reserves the right to bring claims in the Customer’s jurisdiction.

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
